
Former New York Giants wide receiver Plaxico Burress is scheduled to appear in a New York City courtroom today on criminal gun charges.
According to reports in The New York Daily News on Sunday, the case is scheduled to be delayed because Burress’ attorney, Benjamin Brafman, has been unable to strike a plea deal with prosecutors. The prosecution has not yet agreed to the adjournment request.
Brafman hopes to get the case delayed until September. The attorney believes if the case is successfully adjourned until the fall, and a deal can’t be reached by then, a possible trial wouldn’t take place until 2010.
Burress faces two counts of second-degree criminal possession of a loaded and unlicensed handgun, a Glock semiautomatic pistol, each carrying a mandatory three and a half years in prison. He has pleaded not guilty and remains free on $100,000 bail.
If the charges are successfully delayed until the fall, Burress may be able to play in the upcoming football season if picked up by another team.
The wide receiver was released by the New York Giants last year during the off-season after accidentally shooting himself in the leg at a New York nightclub.
